Over the past several months, the Free Software Foundation has been
engaged in public discussion of drafts of a new version of the GNU
General Public License - the most popular copyleft license for Free and
Open Source software. It's been kicking up a bit of dust in the FOSS
community, and the mainstream press is all too often grossly
misinformed about the issues at hand.
Today, The FSF released the GPLv3's proposed third draft for public
discussion.
Tucked into the rationale (PDF - http://gplv3.fsf.org/rationale )
document that explains the reasoning behind the changes in the most
recent draft revision is this:
> We considered including medical devices for implantation in the human
> body in the User Product definition. We decided against this, however,
> because there may be legitimate health and safety regulations
> concerning inexpert and reckless modifications of medical devices. In
> any case, it will probably be necessary to convince medical device
> regulators to allow user-modifiable implantable medical devices. We
> plan to begin a campaign to address this issue.
This has implications in a lot of different places - cognitive liberty,
software liability, gene patents (after all, aren't genes code?)...
